La disciplina normativa relativa alla tutela e al prelievo venatorio del colombaccio nelle Province dello Stato Pontificio dall’Editto di Papa Leone XII nel 1826 al disposto
dell’art. 172 n. 20 della legge 20 Marzo 1865

Il merito di avere disciplinato in maniera organica l’attività venatoria nello Stato Pontificio va attribuito al 252° Papa della Chiesa cattolica cioè Leone XII, al secolo Annibale Francesco Clemente Melchiorre Girolamo Nicola Sermattei Della Genga (Genga 1760 – Roma 1829).
Il futuro pontefice nacque a Genga (AN), piccolo borgo fortificato feudo della famiglia paterna e fu avviato alla carriera ecclesiastica fu sacerdote, nunzio apostolico, cardinale ed infine papa.
Sembra che la sua elezione nel 1823, osteggiata dalla Francia, sia stata favorita dalle sue precarie condizioni di salute, questa circostanza lo fece ritenere prossimo alla morte e quindi la sua pontificato doveva essere utile per prendere tempo in attesa di un candidato maggiormente condiviso.
Nonostante abbia ricevuto l’estrema unzione 17 volte il suo pontificato durò 6 anni.
Appassionato cacciatore frequentava la sua casa di caccia vicino a Spoleto dove la famiglia possedeva una tenuta, ancora oggi a Genga dove trascorse la gioventù e dove tornò, in una specie di esilio forzato, dopo lo scioglimento da parte di Napoleone dello Stato della Chiesa, si tramandano aneddoti sulla sua passione per l’attività venatoria e per la cinofilia.
Come pontefice non fu particolarmente amato dal popolo perché regnando nel periodo della restaurazione adottò una linea rigidamente reazionaria, a Roma gli fu dedicato un sonetto ispirato alla sua passione per la caccia e alla sua linea politica:
Quando il papa è cacciatore i suoi stati son le selve, i ministri sono i cani ed i sudditi le belve.
Nei giardini vaticani nel 1825 fece realizzare un allevamento di fagiani e nello stesso periodo commissionò ad un armaiolo di Ferrara una coppia di doppiette su misura con le quali il papa sparava particolarmente bene tanto che concesse un vitalizio all’artigiano.
Prima dell’Editto di Leone XII, datato 10 luglio 1826, esistevano bandi, notificazioni, avvisi che disciplinavano singole problematiche venatorie in funzione delle esigenze e criticità che via via si presentavano, invece il suo regolamento ha carattere generale e per questo è innovativo. Significativo l’incipit a firma del Camerlengo Cardinale Galleffi: “La conservazione delle specie dei quadrupedi e volatili utili, ormai per comun lamento diminuita a cagione degli arbitrari e distruttivi modi di cacciare . . . hanno mosso il provvido animo di Sua Santità LEONE PAPA XII, felicemente regnante, a volere che siano con opportune leggi generali regolate le caccie in tutto lo Stato. . . .“.
A testimonianza di quale rilievo avesse già a quell’epoca la caccia al colombaccio, l’Editto dedica a questa tradizionale pratica venatoria diversi articoli:
l’art. 15: “Niuno potrà piantare ne’ luoghi non vietati caccia di palombi con preparazione di sito tanto a rete che ad archibugio, se non alla distanza di mille passi d’aria d’intorno da altra, la quale già sia stata antecedentemente stabilita, e da due anni addietro consecutivi non lasciata d’essere in esercizio”. Anche gli artt. 16, 17, 18 e 19 disciplinano indirettamente l’utilizzo e la preparazione degli appostamenti.
Invece l’art. 26 recita: “Dove sono caccie fisse o stabili o capanne o poste o reti o vischi per cacciare, non sarà lecito ad alcuno nel tempo che si esercita la caccia, né di giorno né di notte, di sparare archibugi se non alla distanza intorno di cinquecento passi d’aria, né di fare altro rumore che possa spaventare e allontanare di colà gli animali, se non alla distanza di cinquecento passi d’aria, specialmente nelle caccie de’ palombacci.”
L’art. 28 riduce addirittura la libertà di azione del proprietario: “Nessuno nelle macchie destinate alla caccia di palombacci, neppure il proprietario, potrà in alcun modo di suo arbitrio scrociare, tagliare o svellere dal suolo quercie, cerri ed altri alberi di alto fusto, ma avanti di ottenere la consueta licenza dalla Sacra Consulta farà nota la sua volontà all’autorità locale, la quale, inteso il parere del capocaccia e di due periti cacciatori, darà o negherà il consenso, secondo che richiederà il vantaggio o il discapito della caccia, restando però sempre aperta la via, a chi si trovi gravato, di ricorrere alle competenti superiori autorità.”
Dopo l’entrata in vigore dell’Editto giunsero proteste e richieste di modifica da parte del “mondo venatorio” di allora perché l’art. 3 vietava la caccia dal 1° marzo al 1° agosto di ogni anno ad eccezione di quella degli uccelli di palude e degli animali ritenuti nocivi. Così il Cardinale Galleffi dovette mettere di nuovo mano alla legge emanando una Notificazione a parziale modifica dell’Editto che, in considerazione del fatto che i colombacci sono uccelli migratori e solo un numero ridotto nidifica nello Stato Pontificio, consentiva la caccia durante l’intero mese di marzo di ciascun anno, ma esclusivamente da appostamento cioè dove “ . . . sia fabbricata una caccia con fissa e stabile preparazione del sito . . . “.
Una successiva notificazione sotto il pontificato di Papa Gregorio XVI del 1839 a firma del Cardinale Giustiniani sostanzialmente non modificò le disposizioni relative alla caccia al colombaccio che poteva essere praticata nel mese di marzo su tutto il territorio e non solo da appostamenti fissi.
Con l’annessione delle ex Province pontificie al Regno d’Italia (1860) si verifica una diversificazione anomala della disciplina normativa, infatti Bologna, Ferrara, Forlì e Ravenna mantengono le leggi pontificie, invece nella provincia dell’Umbria che all’epoca comprendeva anche il circondario di Rieti e nelle province delle marche, non ancora definite regione Marche, viene promulgata la legge vigente nel Regno di Sardegna.
Questa all’art. 1 delle Regie Patenti di Carlo Alberto del 1856 vietava la caccia a tutte le specie dal 15 marzo al 15 agosto di ogni anno, quindi anche al colombaccio e non prevedeva alcun riferimento normativo per gli appostamenti di caccia ai colombacci, evidentemente sconosciuti in Piemonte.
Nel 1865 una nuova legge attribuì ai consigli provinciali la competenza di stabilire i periodi di divieto di caccia. Una notificazione dell’Amministrazione Provinciale di Macerata del 25 marzo 1885 vietava la caccia agli uccelli dal 1 marzo a tutto il mese di luglio ad eccezione dei “. . . volatili che sono di mero transito . . .“ tra i quali le “palombe” per i quali era consentita la caccia con il solo fucile fino al 15 aprile.

Conclusioni
Dall’esame del sistema normativo è possibile rilevare che già due secoli fa si erano manifestate problematiche inerenti la non corretta gestione venatoria che avevano causato una sensibile riduzione della fauna selvatica. Probabilmente questo era dovuto ad un prelievo eccessivo, esercitato dalle popolazioni rurali per necessità alimentari, con mezzi molto impattanti come reti, lacci, panie vischio e altro e anche con raccolta di uova e nidiacei durante il periodo riproduttivo. Per porre dei limiti all’esercizio venatorio fu emanato l’Editto del 1826 che introduce numerosi divieti, tra i quali il divieto di caccia dal 1° marzo al 1° agosto e disciplina con particolare attenzione la caccia al colombaccio nello Stato Pontificio. Successivamente con la legge sarda, si riduce il periodo in cui la specie è cacciabile nel mese di marzo, ma spariscono completamente le disposizioni che disciplinano gli appostamenti specializzati evidenziando una involuzione nella gestione venatoria.
In generale si nota un atteggiamento permissivo da parte dei legislatori nei confronti del prelievo di uccelli migratori dove la discriminante sul livello di tutela è data dal fatto che la specie sia nidificante o meno nei confini dello Stato, che all’epoca corrispondeva ad una sola porzione della penisola italiana.
Dopo il 1865 viene attribuito ai consigli provinciali il potere di decidere i periodi di divieto, nel caso della notificazione emanata dalla Deputazione provinciale di Macerata nel 1885 viene consentita la caccia al colombaccio fino al 15 aprile, in virtù del fatto che la specie, come le beccacce, i beccaccini e altre non è più nidificante, mentre nella Notificazione del 1827 veniva menzionata la presenza di esemplari nidificanti all’interno dello Stato.
Verosimilmente i disboscamenti effettuati nella seconda metà dell’800 per ottenere maggiori superfici agricole hanno avuto i loro effetti negativi sull’ambiente e sulla scomparsa della popolazione di colombacci nidificante.

The future pontiff was born in Genga (AN), a small fortified hamlet of the paternal family and was initiated into an ecclesiastical career as a priest, apostolic nuncio, cardinal and finally pope.
It seems that his election in 1823, opposed by France, was favored by his precarious health conditions, this circumstance made him feel close to death and therefore his pontificate had to be useful to take time waiting for a more shared candidate.
Although he received the extreme unction 17 times his pontificate lasted 6 years.
Passionate hunter used to go to his hunting lodge near Spoleto where the family owned an estate, still today in Genga where he spent his youth and where he returned, in a kind of forced exile, after Napoleon’s dissolution of the Papal States, pass on anecdotes about his passion for hunting and for cynophilia.
As a pontiff he was not particularly loved by the people because he reigned in the period of restoration and adopted a rigidly reactionary line; in Rome he was dedicated a sonnet inspired by his passion for hunting and his political line:
When the Pope is a hunter, his states are the woods, the ministers are the dogs and the subjects are the beasts.
In the Vatican gardens in 1825 he had a pheasant breeding and in the same period he commissioned a pair of custom-made shotguns to a Ferrara gunsmith, with whom the pope fired particularly well so that he granted a lifetime to the craftsman.
Before the death of Leo XII, dated 10 July 1826, there were calls, notifications, notices that governed individual hunting issues according to the needs and critical issues that gradually presented themselves, but its regulation is general and for this reason it is innovative. The incipit signed by Camerlengo Cardinal Galleffi is significant: “The conservation of the species of quadrupeds and useful birds, by now diminished by communi- cation due to the arbitrary and destructive ways of hunting. . . they have moved the providential soul of His Holiness LEON PAPA XII, happily reigning, to want that they are with appropriate general laws regulated the hunts throughout the State. . . . “.
As evidence of the importance of hunting for wood pigeons at that time, Editto devotes several articles to this traditional hunting practice:
Article. 15: “No one will be able to plant in the places not forbidden the hunting of pigeons with the preparation of a site as a network or an arquebus, if not at the distance of a thousand steps of air around, which has already been previously established, and two years ago, in a row, not leaving the factory in operation “. Also the articles 16, 17, 18 and 19 indirectly regulate the use and preparation of stalking.
Instead the art. 26 states: “Where there are fixed or stable hunts or huts or posts or nets or hunts to hunt, it will not be lawful to anyone in the time that hunting is practiced, neither by day nor by night, to shoot arquebuses if not at the distance of five hundred paces of air, or to make another noise that could scare and turn away the animals from there, if not at the distance of five hundred air passages, especially in the chase of ‘palombacci.’
Article. 28 even reduces the freedom of action of the owner: “No one in the spots intended for the hunting of palombacci, not even the owner, will in any way of his own will be able to rape, cut or float oaks, oaks and other tall trees from the ground, but forward to obtain the usual license from the Sacra Consulta will make known its will to the local authority, which, understood the opinion of the hunters and two hunters, will give or deny the consent, according to which will require the advantage or the detriment of the hunt, remaining but always open the way, to those who are burdened, to resort to the competent superior authorities. ”
After the entry into force of the Edict came protests and requests for modification by the “hunting world” of then because the art. 3 forbade hunting from 1 March to 1 August each year except for that of marsh birds and animals considered to be harmful. So Cardinal Galleffi had to put his hand to the law by issuing a Notification to partially modify the Edict that, in consideration of the fact that the pigeons are migratory birds and only a small number nidifica in the Papal States, allowed hunting during the month of march of each year, but exclusively from stalking that is where “. . . a hunter with fixed and stable site preparation is manufactured. . . “.
A subsequent notification under the pontificate of Pope Gregory XVI of 1839 signed by Cardinal Giustiniani substantially did not change the provisions relating to the hunting of woodpigeons that could be practiced in March throughout the territory and not only by fixed stalemates.
With the annexation of the former Pontifical Provinces to the Kingdom of Italy (1860) there is an anomalous diversification of the normative discipline, in fact Bologna, Ferrara, Forlì and Ravenna maintain the papal laws, instead in the province of Umbria which at that time also included the district of Rieti and in the provinces of the brands, not yet defined Marche region, is promulgated the law in force in the Kingdom of Sardinia.
This in art. 1 of the Patent Regimes of Carlo Alberto of 1856 forbade hunting of all species from March 15 to August 15 of each year, therefore also to the wood pigeon and did not provide any normative reference for the pigeon hunting ambushes, apparently unknown in Piedmont.
In 1865 a new law gave the provincial councils the power to establish hunting ban periods. A notification by the Provincial Administration of Macerata of March 25, 1885, forbade the hunting of birds from March 1 to the entire month of July except for the “. . . birds that are mere transit. . . “Among which the” palombe ” ( Columba palumbus) for which hunting with the only rifle was allowed until April 15th.

Conclusions

From the examination of the normative system it is possible to notice that already two centuries ago there were problems concerning the incorrect hunting management that had caused a significant reduction in wild fauna. Probably this was due to an excessive levy, exercised by the rural populations for food necessities, with very impacting means such as nets, laces, mistletoe and more and also with collection of eggs and nestlings during the reproductive period. In order to place limits on hunting practice, the Edict of 1826 was issued, introducing numerous prohibitions, including a ban on hunting from March 1st to August 1st, with particular emphasis on hunting for wood pigeons in the Papal States. Subsequently with the Sardinian law, the period in which the species is huntable in March is reduced, but the provisions governing the specialized stalking completely disappear, highlighting an invasion in the management of hunting.
In general, there is a permissive attitude on the part of the legislators towards the removal of migratory birds where the discriminating on the level of protection is given by the fact that the species is breeding or not in the borders of the State, which at the time corresponded to a single portion of the Italian peninsula.
After 1865 the provincial councils were given the power to decide the periods of prohibition, in the case of the notification issued by the Provincial Deputation of Macerata in 1885 the hunting of the wood pigeon is allowed until April 15th, by virtue of the fact that the species, like the woodcock, snipe and other is no longer nesting, while in the Notification of 1827 was mentioned the presence of nesting specimens within the state.
Likely the deforestation carried out in the second half of the 800 to obtain larger agricultural areas had their negative effects on the environment and on the disappearance of the nesting pigeon population.
